1. Participating Schools and applicant schools have already agreed to the terms of the Privacy Policy when registering to receive instruments, and the applicable Privacy Policy can be found here.

2. This Privacy Policy explains Fresh One Production Limited (“Fresh One", “we” “us” and “our””) policies on privacy in relation to personal data collected from users of the Site (other than schools and their staff and applicants where the above Privacy Policy applies). This Privacy Policy forms part of the General Terms of Use of the Site and the Terms and Conditions. By using the services on the Site, and by taking part in the Instrument Amnesty, you consent to the collection and use of your personal data for the purposes authorised below and for any other purpose which is reasonably necessary for the provision of the proper administration of the Site, Campaign and operation and implementation of the Instrument Amnesty.

3. We will use any personal information collected from the Site or during the Pledge Process or provided to us from the Change.org petition process in accordance with all applicable laws and regulations relating to the collection, processing and retention of personal data, including the Data Protection Act 1998 (as may amended) (the "Data Protection Act"). Further details on the Data Protection Act can be found on the Information Commissioner's website.

4. Personal information you are asked to supply during your use of the Site and personal information requested as part of the Pledge Process (including but not limited to your name, email address, city, and postcode) ("Data"), may be used by Fresh One and our group companies, service providers, subcontractors, employees, agents and advisors (including legal and insurance advisors) and project partners (including Oxfam) as follows: (i) in connection with processing your instrument donation and delivering it to the School as part of the Pledge Process and the Instrument Amnesty; (ii) to confirm you are over 18; (iii) to contact and update you by email about the progress of your instrument during its journey (as notified on the Pledge page of the Site you will be able to unsubscribe from any further emails about your instrument(s)’ journey by clicking the appropriate link in the email); and/or (iv) as otherwise set out on the Site. In addition, we may at our discretion disclose this information to the police, regulatory bodies or any legal advisers in connection with any alleged criminal offence or suspected breach of any of the terms and conditions posted on this Site by you, or otherwise where required by law.

Oxfam

5. Oxfam will be handling Donors’ personal data on behalf of Fresh One whilst processing the in-store instrument Pledge Process, logging the receipt of instruments and processing Donor pledge forms. Such data will be processed in accordance with the terms of this Privacy Policy.

If you have opted-in during the Pledge Process to receive further communications from Oxfam about their other projects and activities, then your data will be handled by Oxfam and processed by Oxfam as data controller, and the terms of Oxfam’s privacy policy will apply so please read this carefully before opting in.

Change.org

6. Change.org, a US-based website, powers a petition for the Campaign and any information you give as part of the petition process will be dealt with in accordance with Change.org’s privacy policy, and you use the Change.org site subject to their terms and conditions and privacy policy, so please read these carefully before you add your name and data to the petition. You will receive emails from Change.org but you can unsubscribe from these emails at any time. Where you elect to publicly show your name, location or petition message on the change.org website, Fresh One may use and publish this information for the purposes of the Campaign and Instrument Amnesty, and Fresh One shall process such data in accordance with this Privacy Policy.

7. All Data is held in secure computer storage facilities and may also be held in paper-based files. We take steps to protect the personal information we hold from misuse, loss, unauthorised access, modification or disclosure.

8. We will hold your Data and Contributions for as long as is necessary and reasonably required for the Programme, Campaign and Instrument Amnesty, thereafter such Data will be destroyed securely.

9. Individuals’ personal information changes frequently and we aim to keep our records up to date but we are reliant on you to notify us when your personal information changes or where we have recorded your personal information incorrectly. We can make most changes to your details over the telephone or via email. You also have the right to obtain a copy of any personal information which we hold about you and to notify us of any inaccuracies. You will need to verify your identity and specify what information you require. We may charge you a fee to cover our costs incurred in providing you with a copy of your information. 10. The Site may contain links to other websites. Please note that Fresh One is not responsible for the privacy practices of such other websites, and we recommend you read the privacy statements and cookies policies immediately on entering other websites. This Privacy Policy applies only to information collected through the Site.

12. Fresh One reserves the right to make changes to this Privacy Policy without prior notice and any such changes will be posted on the Site. We will however use Data in accordance with the Privacy Policy applicable at the time Data was collected. You will be deemed to have accepted any variations if you continue to use the Site after any changes have been posted.

13. This privacy policy will be exclusively governed by and construed in accordance with the laws of England. Any disputes arising under this Privacy Policy are subject to the exclusive jurisdiction of the courts of England.
